In Florida, transportation carriers are employers who can be held vicariously liable for the negligent acts of their employees, so long as their negligent employee was acting within the course and scope of their employment at the time of the accident at-issue. Vicarious liability principles empower plaintiffs to pursue “deeper pockets” to ensure a full and adequate recovery, but it is by no means a guarantee.
