Vicarious and Independent Liability

In Florida, transportation carriers are employers who can be held vicariously liable for the negligent acts of their employees, so long as their negligent employee was acting within the course and scope of their employment at the time of the accident at-issue. Vicarious liability principles empower plaintiffs to pursue “deeper pockets” to ensure a full and adequate recovery, but it is by no means a guarantee.

Of course, employers can also be held liable for their own independently negligent (or otherwise wrongful) misconduct. For example, if a bus company hires a known alcoholic as a bus driver, then, in the event that the driver becomes intoxicated and gets into an accident while driving a company bus, the company can be sued directly on the basis of negligent hiring.
